AMTRAK - USA RAIL PASS CONTRACT

All rates for Amtrak Rail Passes are according to the Rail Pass type, passenger qualifications and seasonality, in economy seating only. The rates, terms and conditions herein do not apply for any point to point or sector fares.

Child rates apply to children aged between 2 and 15 years inclusive, and are 50% of adult fares. Child rates apply for a maximum of two (2) children when accompanied by a full-fare paying adult. Student or Senior fares are NOT available.

Travel on the Acela Express, Auto Train or Metroliner is NOT allowed.

Where any portion of an Amtrak Rail Pass will be utilised during Peak Season, the Peak Season Rate will apply to the entire Rail Pass. An Amtrak Rail Pass is valid for 12 months from the date of issue however supplements will apply should commencement of travel not take place in the current contract year, or should any portion of travel not take place in the valid season.

RESERVING SECTORS and RECONFIRMATION

Pre-reserving sectors on an Amtrak Rail Pass prior to departure from Australia is not mandatory, however passengers are highly recommended to make reservations for their preferred service/s prior to departing from Australia, and to reconfirm service details on the day of planned travel with Amtrak in the USA. Pre-reserving is especially important should the client require an upgrade to Business Class Seats and/or Sleeper Accommodation. Canada & America Travel Specialists is not required to reserve the sector booking, however you may refer the client to Asia Pacific Travel Marketing Services directly for this service.

ISSUANCE FEES

Non-Refundable / Non-Commissionable Amtrak Rail Passes do NOT incur an issuance fee, UNLESS sectors are pre-reserved. In that event an issuance fee of AU$25.00 (GST exempt) applies per client/client party (i.e. party members are undertaking the same point-to-point journeys). If separate journey itineraries are required for any individuals of a party, individual issuance fees will apply per file. Passengers are recommended to reconfirm service details on the day of planned travel with Amtrak Rail in the USA.

ROUTES and SERVICES

Amtrak is the national rail network of America. Almost all routes offer passengers a choice of economy, business or first class seats and/or sleeping accommodation travel options. Additional charges apply for upgraded accommodation / seat options. Departure and arrival times and the actual train number or train in service are subject to change due to season, prevailing conditions and equipment

Each confirmed reservation acknowledgement by CANAM will be by way of confirmation/invoice.

AMENDMENTS

Canada & America Travel Specialists (CANAM) reserve the right to impose an amendment fee of AUD$35.00 (GST exempt) after issuing of documentation; a fee of AUD$35.00 (GST exempt) for any third or subsequent amendment to a reservation regardless of whether documentation has been issued. Further penalty fees for Amtrak Rail Passes vary according to seasonality, sector requirements, seating, etc and will be advised by Amtrak at the time of amendment. Please refer to CANAM booking conditions for further details on amendments.

CANCELLATION / REFUND POLICY

Any Amtrak Rail Pass and/or associated Ticket/s 'LOST' in transit or stolen, regardless of blame or fault, are NON-REFUNDABLE. Ticket/s will only be re-issued when RE-PAID in FULL. It is therefore recommended that ALL documentation returned, be sent via some form of registered postal system or courier. Canada & America Travel Specialists (CANAM) cannot be held liable for documents lost in transit. To minimise delivery mishaps, CANAM will only dispatch Amtrak Rail Passes by DX Travcour. Should documentation be requested to be dispatched by any other means, the responsibility and cost of that means must be met by you . Any Amtrak Rail Pass and associated ticket/s that require a refund without return of the original documentation issued, WILL NOT be considered for processing. NO refunds are available for partially used Amtrak Rail Passes. Any Amtrak Rail Pass requiring refund will only be considered for processing when the following is provided: The ?ORIGINAL? Amtrak Rail Pass and all associated ticket/s must be returned for processing. The refund must be submitted within 12 months from ?Date of Issue?, as shown on the Pass/Ticket/s, unless indicated otherwise. Once the value of a refund has been determined by Amtrak, passengers have two options on how to receive the refund value: 1. Passengers may receive the full calculated refund value in the form of a non-refundable exchange voucher valid for future Amtrak travel purchases. 2. Or, passengers may receive the calculated refund value, less any service charges/fees (if applicable) in the form of cash, check or credit to credit card, depending on the form of payment that was used for the ticket(s) being refunded. Cancellation fees for Amtrak Rail Passes vary according to seasonality, sector requirements, seating, etc and will be advised by Amtrak at the time of cancellation. In addition, Canada & America Travel Specialists (CANAM) will impose a cancellation fee of AUD$75.00 (including GST) per file in the event of a cancellation/refund where final documents have been issued. PAYMENT PROCEDURES

All reservations must be prepaid in full. The rate paid to Asia Pacific Travel Marketing Services will be by way of cheque, direct deposit electronic funds transfer or Money Direct (code = CANAM) in AUD.Please refer to CANAM booking conditions for further details on amendments.

DOCUMENTATION

Upon our receipt of your full prepayment, CANAM will return the Amtrak Rail Pass which your clients must present to the Amtrak service counters at each station before commencing each journey. Such pass will show the Gross fare and passenger name. Amtrak Rail Pass holders must also present official Amtrak ticket/s for individual sector/s train journeys, as obtained prior to departure or through Amtrak Rail on arrival into the USA. Only official Amtrak Rail Passes and associated tickets will be accepted by Amtrak as documentation for travel. Fax copies will not be issued or accepted in place of original documents. RESTRICTIONS

Each Amtrak Rail Pass is valid for 15 or 30 consecutive days of travel (except California Pass), with unlimited stopovers in the respective region of travel (refer to attached flyer for details of regional coverage for each Amtrak Rail Pass). For the California Pass, the 21-day pass allows 7 days of state-wide travel including travel on the Coast Starlight. Travel is NOT permitted on the California Zephyr, Sunset or Southwest Chief.

All rates, fees, terms and product services are subject to change. All reservations are subject to cancellation due to conditions herein as well as strikes, Acts of God, loss of inventory or conditions beyond the control of Amtrak. There will be no additional charge if Amtrak accommodate its clients on alternate services without notice due to conditions beyond its control. Canada & America Travel Specialists (CANAM) gives notice that in issuing tickets and coupons for travel, conveyance or transportation by any means, and in making arrangements for hotels or other accommodation, it is acting not as principal but as agent only and is not itself a carrier, or hotelier and does not own, manage, control or operate any transportation vehicle, hotel, restaurant or other supply of services. Therefore, no liability is accepted by Asia Pacific Travel Marketing Services for the acts, omissions or default, negligent or otherwise, of the providers of the transportation, hotel or other accommodation or other services. Canada & America Travel specialists is not liable for any injury, damage, loss, delay, additional expenses or inconvenience caused by providers of transportation, hotel or other accommodation or other services.
